ACCEPTANCE OF TERMS

By accessing this website or engaging the services of Sam Hanley Photography, you agree to be bound by these Terms & Conditions. Please read them carefully. If you do not agree, please do not use this website or engage my services.

These Terms & Conditions constitute a legally binding agreement between you (the client) and Samantha Hanley operating as Sam Hanley Photography, a wedding photographer based in Quebec, Canada.

SERVICES

Sam Hanley Photography provides wedding photographer services as agreed upon in individual client proposals or contracts. The specific scope of services, deliverables, timeline, and pricing will be outlined in a separate written agreement provided to each client.

All services are subject to availability. I reserve the right to decline any booking at my discretion.

BOOKING PROCESS

A booking is confirmed only upon receipt of a signed contract and the required 30% retainer payment. Availability is not held until both have been received. Bookings are accepted on a first-come, first-served basis.

PAYMENT TERMS

A non-refundable retainer is required to secure your booking. The deposit amount will be specified in your individual contract.

The remaining balance is due on the dates specified in your contract. Late payments may result in delays to deliverables or cancellation of services.

All prices are in CAD dollars unless otherwise stated.

CANCELLATION & REFUND POLICY

All deposits and retainers are non-refundable, as they are used to reserve your date and cover preliminary work.

Cancellations made close to the event date may result in the full contract amount being owed, as it may not be possible to rebook the date. Specific cancellation terms will be outlined in your individual contract.

I strongly recommend purchasing event insurance to protect your investment.

INTELLECTUAL PROPERTY

All creative work produced by Sam Hanley Photography — including photographs, videos, designs, and written content — remains the intellectual property of Samantha Hanley unless otherwise agreed in writing.

Upon receipt of full payment, clients are granted a personal, non-exclusive license to use the delivered work for personal purposes. This license does not include the right to resell, sublicense, or use the work for commercial purposes without prior written consent.

PORTFOLIO & MARKETING USAGE

Sam Hanley Photography reserves the right to use images, videos, or other creative work produced for clients in portfolios, websites, social media, and marketing materials, unless a written agreement stating otherwise has been signed.

If you prefer your work not be used for marketing purposes, please notify me in writing prior to signing your contract.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Sam Hanley Photography and Samantha Hanley shall not be liable for any indirect, incidental, special, or consequential damages arising out of the services provided.

In the event of any failure to deliver services due to circumstances within my control, liability shall be limited to a refund of amounts paid.

FORCE MAJEURE

Sam Hanley Photography shall not be held liable for failure to perform services due to circumstances beyond reasonable control, including: acts of God or force majeure, extreme weather, natural disasters, pandemic or public health emergencies, government restrictions, illness or injury, or venue closures.

In such cases, I will work with you in good faith to reschedule where possible.

DISPUTE RESOLUTION

In the event of a dispute, both parties agree to first attempt resolution through good-faith communication. If unresolved, disputes shall be handled through mediation or arbitration in Quebec, Canada before pursuing legal action.

These Terms & Conditions are governed by the laws of Quebec, Canada.

WEBSITE USE

The content on this website is for general informational purposes only. You agree not to use this website in any way that is unlawful or harmful to Sam Hanley Photography.

CHANGES TO THESE TERMS

I reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date.
